NATIONAL HEADLINES "FATHER GETS CUSTODY TO STOP CHILD BEING PUT INTO DAYCARE": Should he have gotten custody?
In that specific case, which you wrote was 15 years ago, yes I would say the father should have gotten custody of the child. I'm curious if the situation would happen the same today. The mother should have been reported to CPS (as dependency court over rules family court) so they could do an investigation and find the mother unfit. They would then have custody of the child and could have released to the father. I'm a CPS worker and have had very similar cases to this - where we removed from one parent and the other is interested in custody and not a danger to the child - so the other parent gets custody. It those cases, it doesn't matter what family court has ruled.
